从一起房屋拆迁案看我国行政程序存在的问题及解决对策

一、从城市房屋强制拆迁案入手案情:某市某区公民王某(原告)称,区人民政府(被告)于2007年11月15日在未办理任何法律手续的情况下,由区政府投融资管理中心(第三人)强行拆除其房屋。市中级人民法院于2008年4月10日裁定将案件移交审理。原告王某称,被告于2007年11月15日在为办理任何法律手续的情况下,强行拆除原告的房屋,属于程序违法。根据国务院城市房屋管理条例之规定,强行执行的前提是拆迁行政裁决,在未进行裁决的情况下,强行拆除原告的房屋是违法行为,要求恢复原状、赔偿损失并提供了相关证据。 First, from the case of forced demolition of urban housing Case: Wang, a citizen of a city (plaintiff) said the district people’s government (defendant) on November 15, 2007 in the absence of any legal formalities, the investment by the district government Financing Management Center (third party) to dismantle their houses.
