语言是法律的载体。法律语言影响着法律的方方面面,对法律的发展起着至关重要的作用。在欧洲大陆所有的国家中,英国的法律保持了最为坚定的民族特色,形成了独具特色的普通法体系,这与它独特的法律语言密不可分。可以说,没有这种独特的法律语言,就没有普通法系。这种法律语言,是一种不同于古罗马的法律语言。令人惊讶的是,这种法律语言并不是英语,而是法语。接下来,笔者就简要介绍一下英国法律语言的变迁及其对我国法治现代化建设的启示。
Language is the legal carrier. Legal language affects all aspects of law and plays a crucial role in the development of law. Of all the countries in the European continent, English law maintains the most determined national identity, forming a distinctive common law system that is inextricably linked to its unique legal language. It can be said that without this unique legal language, there is no common law system. This legal language is a different legal language from ancient Rome. Surprisingly, this legal language is not English, but French. Next, I briefly introduce the changes in the English legal language and its enlightenment on the modernization of our country.
