最终通过的美国《2010年华尔街改革和消费者保护法》(Dodd-Frank Wall Street Reform and Consumer Protection Act)中大量涉及金融消费者保护的内容。目前美国金融消费者保护制度建设存在很大的矛盾与分歧,这充分体现了消费者利益与银行家利益的冲突,法律的最终版本是双方利益博弈的结果。因此,我国在对金融消费者保护立法时不仅要积极学习美国法律中的一些值得关注的根本问题,同时也要注意甄别与检视那些政治妥协的结果,不能一概加以吸收利用。要取其精华、去其糟粕,积极建设符合我国国情的金融消费者保护体系。
The final passage of the U.S. Dodd-Frank Wall Street Reform and Consumer Protection Act deals heavily with financial consumer protection. At present, there are many contradictions and differences in the construction of financial consumer protection system in the United States. This fully reflects the conflict between the interest of consumers and the interest of bankers. The final version of the law is the result of the interest game between the two parties. Therefore, when protecting legislation for financial consumers, our country not only actively studies some fundamental issues of concern in American law, but also pays attention to the results of those political compromises that can not be absorbed and utilized. To take its essence, to its dregs, and actively building a financial consumer protection system in line with China’s national conditions.
