不动产登记制度是否引入公证制度曾引起了激烈的探讨,但最终《物权法》出台之后未将公证制度引入不动产登记制度中。但经过多年的实践看,物权法未引入公证制度是个缺憾。目前我国物权登记制度本身存在缺陷,依靠本身的制度并不能解决这些问题,若引入公证制度将有益于促进很多物权登记制度缺陷问题的化解。参考国外立法例看,我国不动产登记制度引入公证制度具有必要性和可行性。
Real estate registration system whether or not to introduce a notarization system has caused heated discussions, but eventually the “Real Right Law” after the introduction of the notary system into the real estate registration system. However, after many years of practice, it is a pity that real property law did not introduce notary system. At present, the system of real right registration in our country is flawed by itself. It can not solve these problems by relying on its own system. If notary system is introduced, it will be helpful to resolve the defects of many real right registration system. With reference to the legislation of foreign countries, it is necessary and feasible to introduce the notarization system into the real estate registration system in our country.
