随着商品经济的发展,房地产产业的发展催生出一种新生事物——业主委员会。《物权法》的出台是一种进步,但其只是原则性的规定,对业主委员会的性质及法律上的定位没有做出实质的规定,针对性不强。这样,在司法实践中,操作性不强,各级法院没有一个统一的标准。各个地方法院在讼诉中也会有不同的处理方式,同在社会主义法制的中国,做出的判决会不一样,所以我们有需要进一步分析业主委员会的法律地位,达到全国统一性认识。本文从业主委员会的产生、性质、面临的问题及从实体法和程序法这几方面来阐述。业主委员会在解决小区业主之间的纠纷,对于调整社会关系中起着一定的作用,所以在地位和作用上的重要性不可忽略,对我们民主建设也有着重大的实践意义。
With the development of commodity economy, the development of real estate industry has given birth to a new thing - owners committee. The introduction of “Property Law” is a kind of progress, but it is only the principle of the provisions of the owners of the Commission’s nature and legal positioning did not make substantive provisions, targeted is not strong. In this way, in judicial practice, operability is not strong, and courts at all levels do not have a uniform standard. All local courts will also have different ways of handling suits. Judging will be different from that made in China under the socialist legal system. Therefore, we need to further analyze the legal status of the owners’ committees and achieve a national awareness of unity. This article elaborates from the production, the nature and the problems faced by the owners committee and from the substantive and procedural aspects. Owners’ committee resolves disputes among residential property owners and plays a role in adjusting social relations. Therefore, the importance of status and role can not be neglected, and it is also of great practical significance to our democratic construction.
