为了适应社会主义市场经济的发展,我国《物权法》规定了不动产的善意取得制度,该制度对于维护交易安全、促进社会和谐都有着重要的作用。但是在实践中,不动产善意取得制度存在着不少不足之处,如善意的标准模糊、合理价格的判定缺失、登记责任赔偿制度不完善等。要弥补这些漏洞,应采取界定善意之标准、制定具体的合理价格细则,完善登记责任赔偿制度等措施。
In order to adapt to the development of the socialist market economy, the “Property Law” of our country stipulates the goodwill acquisition system of real estate, which plays an important role in maintaining transaction security and promoting social harmony. However, in practice, there are many shortcomings in the system of bona fide acquisition of real estate, such as the fuzzy standard of goodwill, the lack of reasonable price judgment and the imperfect registration liability compensation system. To make up for these loopholes, measures should be taken to define the standard of goodwill, formulate specific and reasonable price rules, and improve the registration liability compensation system.
