随着国家法制的逐步健全,现行法律法规就对外工程承包作出了更加严密的规定,外派人员更是侧重保护对象。同时,劳工管理本身也是涉外项目管理中的一个重要环节,由于项目的劳工主要来源于国内外派和当地聘用两部分,两种用工模式受不同国家法律的调整和约束,因而面临的风险也有所不同。现在,笔者以埃塞某项目为例,结合我国现行法律法规和埃塞当地法律规定,谈谈涉外项目劳工管理注意事项。
With the gradual improvement of the national legal system, the existing laws and regulations have laid down more stringent requirements for the contracting of foreign projects, and the expatriates have placed more emphasis on the protection of the target. At the same time, labor management itself is also an important link in the management of foreign projects. As the project’s labor comes mainly from domestic and foreign factions and local hires, the two employment modes are subject to adjustment and restriction by different national laws and risks different. Now, with a project in Ethiopia as an example, I will talk about the labor management considerations of foreign projects in light of the current laws and regulations in our country and the local laws and regulations in Ethiopia.
