随着社会形势不断发展,劳动教养原有的理论、制度、经验与管理模式等诸多方面,与依法治国方略的要求不相适应。劳动教养制度要适应时代变革,就必须在理论理念、管理体制和执行方式上进行创新。笔者认为,劳动教养执行制度应从执行模式上入手,构建能体现时代特征的管理教育模式,并具有相应的社会保障措施与实践支撑。
With the continuous development of the social situation and the original theories, systems, experiences and management models of labor re-education, it is incompatible with the requirements of the strategy of governing the country according to law. In order to adapt to the reform of the times, the system of reeducation through labor must innovate on the theoretical concepts, management system and implementation methods. The author believes that the implementation of the system of reeducation through labor should start from the implementation model, and build up a management and education model that reflects the characteristics of the times with corresponding social security measures and practical support.
