忽略产业考量的应急行政存在诸多弊端。应急行政的必要性应当存在限度,不能以目的之正当而无限证成手段之合理。事后且居于附属地位的行政补偿无法替代必要且合理的产业考量,其范围有限、不确定等固有缺陷更会显著妨碍应急措施的绩效。风险社会放大了社会对政府风险治理能力的需求,社会利益结构复杂化、突发性风险频现要求精确治理、整体治理,在公共卫生事件应对中当以社会整体利益为宗旨嵌入产业考量,提升应急法制体系的统摄能力。应当在应急建设规划、应急法律规范和应急预案中确立产业考量的独立性和内生性;在应急治理各阶段严格落实产业考量的具体构成;在以市价补偿、及时补偿、独立预算为核心完善行政补偿的同时,以产业保障基金、产业大灾保险为核心推进产业补偿和振兴的市场化、社会化机制,并完善相应的信息披露和社会动员制度。
