试论完善破产管理人的监督约束机制

2007年6月1日起施行的《中华人民共和国企业破产法》正式取代试行长达20多年之久的《中华人民共和国企业破产法(试行)》。新《破产法》总结了我国企业长期以来的破产实践,借鉴了国外破产立法的先进经验,并结合我国现阶段国情,为我国企业破产提供了重要的法律依据。新《破产法》中首次使用破产管理人这一名词,并规定了其任命方式、任职资格、权利义务、法律责任等一系列制度,弥补了原《破产法》在该方面的欠缺,从而更有利于协调法院、债务人、债权人、破产企业职工之间的关系,保护债权人的合法权益,避免债务人 The “Enterprise Bankruptcy Law of the People’s Republic of China”, which came into effect on June 1, 2007, officially superseded the “Enterprise Bankruptcy Law of the People’s Republic of China (Trial)” for more than 20 years. The new Bankruptcy Law summarizes the long history of bankruptcy practices in our country, draws on the advanced experience of foreign bankruptcy legislation and provides an important legal basis for the bankruptcy of our country in light of the current national conditions of our country.
