目前人民陪审员参审案件的职权包括了法律审和事实审,并不能充分发挥人民陪审员的优势,也不符合司法实践的需求,甚至是造成人民陪审员“陪而不审,审而不议”的主要原因。司法改革稳步推进,对人民陪审员制度的改革也拉开帷幕。结合改革实践和域外法比较,并对人民陪审员制度中法律审和事实审的分离机制进行分析可知,探索重大案件由3名以上人以陪审员参加会议庭机制、切实推进事实认定问题清单列表制度以及强化人民陪审员对事实认定的责任制度是切实可行的。

Combining the reform practice with the comparison of extraterritorial law and analyzing the separation mechanism of legal trial and factual examination in the system of people’s jurors, we can see that there are more than three people in major cases to participate in the conference court mechanism with jury members, and effectively promote the list of factual identification questions System and to strengthen the system of accountability of people’s assessors to the facts is practicable.
