所谓小产权并非真正法律意义上的产权,二元土地所有制及对集体建设用地流转的限制是产生小产权房问题的根源。从制度经济学视角来看,小产权房各参与主体的成本收益有较大差异,小产权房不符合我国现有集体建设用地的制度安排,大量小产权房的出现表明外部利润的存在。通过明确集体土地所有权、创新集体建设用地流转制度,将外部利润内在化,从而有效实现最大化经济效益,达到从制度层面解决小产权房问题的目的。
The so-called small property is not a real legal sense of property rights, binary land ownership and the flow of collective construction land restrictions is the source of the problem of small property room. From the perspective of institutional economics, the costs and benefits of the parties involved in small property ownership vary greatly. Small property houses do not meet the institutional arrangements for the existing collective construction land in our country. The appearance of a large number of small property houses shows the existence of external profits. By clarifying the ownership of collective land and innovating the circulation system of collectively-owned land for construction, internalization of external profits can effectively maximize the economic benefits and achieve the purpose of resolving the problems of small property houses from the institutional perspective.
