作为保险合同当事人的投保人和保险人,应依保险合同约定及法律规定履行各自应尽的义务。这也是保险合同得以履行的前提。我国《保险法》虽就保险合同当事人的义务作了相应规定,但由于不少规定存有疏漏及不当之处,致使保险纠纷往往难以得到正确、及时处理。鉴此,本文拟就保险合同当事人之义务作些探讨。 As the insured and the insurer of the parties to the insurance contract, they shall fulfill their respective obligations according to the provisions of the insurance contract and the law. This is also the precondition for the fulfillment of the insurance contract. Although China’s “Insurance Law” makes corresponding provisions on the obligations of the parties involved in the insurance contract, due to omissions and inadequacies in many regulations, insurance disputes are often difficult to be correctly and promptly dealt with. In view of this, this article intends to discuss the obligations of parties to insurance contracts.
