劳动者忠诚义务包括在职竞业限制义务、离职竞业限制义务、保密义务、报告义务、服从义务和其他义务。劳动者忠诚义务的法律渊源,既包括法律、劳动契约、企业内部规章等明文规定,也包括因劳动契约人身隶属性和继续性特征而衍生出的不言自明的法律约束。通过案例统计和分析,笔者对司法实践中常见的六种类型化忠诚义务进行了归纳和研究。
Employee loyalty obligations include on-the-job competitive restrictions, separation restrictions, confidentiality obligations, reporting obligations, obedience obligations, and other obligations. The legal sources of workers' loyalty obligations include not only the express provisions of laws, labor contracts and internal regulations of enterprises, but also self-evident legal constraints derived from personal subordination and continuing characteristics of the labor contract. Through case statistics and analysis, the author summarizes and studies the six types of loyalty obligations common in judicial practice.
