禁止不当联结原则是对行政权行使中的不当联结行为进行规范和调整的法律原则。所谓不当联结是指行政机关以是否作出某项行政行为来要求相对人履行一个与此无正当关联的义务。不当联结的类型可以划分为行政行为附款的不当联结和对待给付间无实质关联两种。不当联结的认定包括阐释立法目的、分析相对人义务性质、判断二者是否有正当关联三个步骤。在司法适用上,应当优先适用将禁止不当联结具体化的法律规则;在没有相关规则的时候,才能直接适用禁止不当联结原则。在举证责任上,不当联结案件的审查应当实行举证责任倒置。 Prohibiting the principle of improper association is the legal principle of regulating and adjusting the improper connection in exercising the executive power.
