深受传统文化影响、基层司法力量薄弱、语言障碍等因素是导致民间调解在藏区依然有着广阔生存空间的主要原因。虽然藏区民间调解具有方便、快捷、效率高等积极作用,但它同时也具有使国家司法权不断被弱化和边缘化的消极作用。对此,本文认为,应在藏区增强法制教育的实效性,强化基层司法力量,协同配合、健全机制,规范民间调解,促其与国家法形成良性互动。 Influenced by traditional culture, grass-roots judicial forces are weak and language barriers are the main reasons that lead to the fact that civil mediation still has a vast living space in the Tibetan areas. Although there is a positive, convenient and efficient civil mediation in Tibet, it also has the negative effect of continuously weakening and marginalizing the country’s judicial power. In this regard, this article believes that we should enhance the effectiveness of legal education in Tibetan areas, strengthen the judicial forces at the grassroots level, cooperate with each other, improve the mechanism, standardize civil mediation and promote its benign interaction with national law.
