民事检察监督与审判的不确定性并不构成实质冲突 ,对法官超出其自由裁量权的案件进行检察监督 ,有利于保证诉讼的公正性。民事检察监督也有利于排除或减少非司法权力对审判的干预。在合理的限度内，检察机关监督的效果是平衡当事人双方的实力，而不会影响当事人之间的平等对抗。
The uncertainty of civil procuratorial supervision and trial does not constitute a substantive conflict. Prosecutorial supervision over cases in which judges exceed their discretion can help ensure the fairness of litigation. Civil prosecutorial oversight can also help eliminate or reduce non-judicial interference with the trial. Within a reasonable limit, the effect of procuratorial supervision is to balance the strength of both parties without affecting the equal confrontation between the parties.
