改革开放以来,以1988年宪法修正案为标志,农村土地流转制度经历了从“禁止流转、允许流转到放开流转”和由模糊不清到明确鼓励的过程。我国在城市化过程中,随着制造业的发展,工业用地的不断发展,迫切要求在土地流转制度上实现新的突破。本文将从法学的视角,分析我国现行有关农村土地流转制度存在的问题,简要阐述了完善我国土地流转制度的必要性,并且提出了相关改善措施。 Since the reform and opening up to the 1988 constitutional amendment as a sign of rural land transfer system has gone from “no circulation, allowing the transfer to the letting go ” and from ambiguous to explicitly encourage the process. In the process of urbanization in our country, with the development of manufacturing industry and the continuous development of industrial land, it is urgent to achieve a new breakthrough in land circulation system. This essay will analyze the problems existing in the system of rural land transfer from the perspective of jurisprudence, briefly explain the necessity of perfecting the land transfer system in our country, and put forward the corrective measures.
