2011年年初以来,北非、中东地区部分国家政局持续动荡。中国在北非、中东地区的能源投资,正面临着巨大的东道国动乱乃至战争风险。在东道国动乱背景下,如何有效保障中国海外能源投资安全,对中国投资者和中国政府都是一个极具现实意义的重要问题。本文试图以中外双边投资保护条约为研究视角,从中国投资者和中国政府两个层面,对东道国动乱背景下的中国海外能源投资安全保障问题进行法律对策研究,以期对保障中国海外投资利益有所贡献。 Since the beginning of 2011, the political instability in some countries in North Africa and the Middle East has continued to fluctuate. China’s investment in energy in North Africa and the Middle East is facing huge turmoil in the host country and even war risks. Under the background of turmoil in the host country, how to effectively safeguard China’s overseas investment in energy resources is an extremely important and important issue for both Chinese investors and the Chinese government. This article attempts to study the Sino-foreign bilateral investment protection treaty as a research perspective, from the Chinese investors and the Chinese government two levels, the background of the turmoil in the host country of China’s overseas investment in energy security issues of legal countermeasures, with a view to safeguarding the interests of China’s overseas investment contribution.
