本案涉及将他人文学艺术作品中的知名角色名称注主册为商标的行为的规制问题。由于文学艺术作品中的角色名称既不构成法定权利类型,亦不属於《反不正当竞争法》所明确规定的合法利益,故如何在商标注册审查程序中予以保护是司法实践中遇到的一个难题。基本案情本案源自将小说中人物哈利·波特(Harry Potter)申请注册为商标引发的纠纷。
This case involves the regulation of the act of trademarking the name of another famous person in other literary and artistic works. Since the names of characters in literary and artistic works do not constitute the type of statutory rights and do not belong to the legitimate interests as clearly stipulated in the Anti-Unfair Competition Law, how to protect them in the process of trademark registration review is one of the problems encountered in judicial practice problem.
