在社会道德实体化为法律的过程中,必须运用一定技术使法律获得与道德有根本不同的可操作性效果。太平天国运动作为与宗教有密切联系的农民运动,其政权建设的成败在很大程度上取决于对其核心道德的坚持程度及其法律化的成败。事实上,太平天国对“上帝信仰”“平等”“大同”等核心道德理想的弘扬造就了其最初的胜利,但在政权建设中由于缺乏有效地将道德转化为法律的技术手段和在法律执行过程中对道德和立法的双重背叛,使得政权逐步丧失其合法性并率先从内部瓦解了政权的道德和法律基础,导致了最终的失败。
In the process of transforming social morality into law, certain techniques must be applied to make the law have radically different maneuverability effects from morality.
