一、隐私法的形成及沿革 人们通常对隐私权的解释是:不被干涉的权利。法律大辞典“隐私权”的条目下写着:“不被干涉的权利。免于被不正当地公开的权利……个人(或组织)如果愿意,可使他本人和他的财产不受公众监视的权利。” 美国宪法中没有提到隐私权的概念。这并不奇怪,在制订宪法的时代,美国的大多数人口分布在农村,城市人口仅占了10%多一点。当时最大的城市——费城,也仅仅只有四万居民。这样的生存环境使得人们尚未对隐私权受到侵害的问题产生忧虑。
