2008年5月1日起正式施行的《行政信息公开条例》在生效十二天后,“遭遇”了汶川大地震的“考验”。在这突发灾难面前,政府依法行政和公开行政的能力得到了良好的表现。但与发达国家和地区在施行政务公开的能力方面相比仍存在一定差距。本文指出要想解决这些问题,我们需要从思想上进一步深化行政信息公开的理念,探寻其存在的必要性,从政治理论上看,行政信息公开存在的逻辑前提主要有:民主政治、人民主权、表达自由权、知情权。
Since May 1, 2008, the “Administrative Information Disclosure Ordinance” came into effect twelve days after the “Wenchuan Earthquake” “test”. In the face of this sudden disaster, the government’s ability to administer affairs according to law and open administration has been well demonstrated. However, compared with developed countries and regions, there is still a gap in their ability to carry out government affairs. This paper points out that in order to solve these problems, we need to further deepen the idea of administrative information disclosure and explore the necessity of its existence from the ideological point of view. From the political theory point of view, the main preconditions for the existence of administrative information disclosure are: democratic politics, popular sovereignty, Freedom of expression, right to information.
