一方提出解除劳动合同,相对方在约定的异议期或者三个月后提出异议的,法院是直接判处异议无效还是对解除权进行实质性审查呢?这个问题是有争议的。一方面得考虑交易安全,一方面得注意促进交易,目前没有大量的理论观点完全支持某一方。从平衡的角度出发,不管异议是否有效,都不能以此来决定解除权的合法性审查。
If one side lifts the labor contract and the opposing party files an objection after the agreed opposition period or three months later, the court directly adjudicates whether the opposition is invalid or whether the substantive examination of the right of termination should be conducted? This question is controversial. On the one hand, the security of transactions must be considered. On the other hand, attention should be paid to facilitating transactions. Currently, there is not a large amount of theoretical arguments that fully support one party. From a balanced standpoint, no matter whether the objection is valid or not, it can not be used to determine the legality of the right of excuse.
