本文以《香港基本法》文本为解释对象,以中央保留原则为研究视角,论证了《香港基本法》第23条中的七类违法行为是中央相对保留的立法事项,第23条立法应当符合维护国家安全和主权完整的授权目的,中央对第23条立法的内容介人并不违背“自行立法”。
This article takes the text of Hong Kong Basic Law as the explanation object and the Central Reservation Principle as the research perspective. It argues that the seven types of offenses in Article 23 of the Basic Law of Hong Kong are the relative legislative issues reserved by the Central Government. The Article 23 legislation should be consistent with the principle of safeguarding the state Security and sovereignty of the purpose of complete authorization, the Central People’s Government on Article 23 of the content of the legislation is not contrary to “self-legislation ”.
