通过一起职业病诊断投诉案例分析,从职业病诊断受理、职业病诊断与鉴定的费用承担、职业病诊断资料提供等方面,指出《中华人民共和国职业病防治法》修改后存在的一些新问题需要关注,希望能在今后的实施细则中更加明确相关条文,使职业卫生监督人员能更好运用法律,保护企业和劳动者的合法权益。
Through a case analysis of complaints of occupational disease diagnosis, it points out some new problems that exist after the revision of “Law of the People’s Republic of China on Prevention and Treatment of Occupational Diseases” from the acceptance of occupational disease diagnosis, the cost-bearing of diagnosis and appraisal of occupational diseases and the provision of diagnosis data of occupational diseases. More detailed provisions in future implementation details will enable occupational health inspectors to make better use of the law and protect the legitimate rights and interests of enterprises and workers.
