在当前严厉的房产调控政策不断出台的背景下,房产买卖双方特别是买方不能以不可抗力为理由解除合同。同时,除非合同有对调控政策的明确约定,双方也不能当然以情势变更为由解除合同。我国司法实践也基本遵循这个规则。作为房产买卖双方,在充分评估风险和政策不可预见性的前提下,应通过合同条款约定来避免调控政策给双方带来的法律风险。
