中西文化的起点不同,也就决定了落脚点的不同。因此,应当从中西法律文化各自的起点出发,探索中西方不同制度的生成路径。立足我国当前法治建设的实际,通过对中西法律文化之间差异的对比,正视二者之间的殊异,理顺两种文化在现代文明进程中的主次关系,在合理的取舍当中寻求两种文化的互补与对接。
