德国职业教育之所以能取得巨大的成绩,与其职业法律所提供的制度支持是密不可分的。在立法上,企业参与德国职业教育的立法历史较为悠久。德国在其正式颁布的法律上就明确企业作为职业教育的主体的地位,以专门立法的形式对教育企业的资格要求进行细致而全面地规定,并以合同的形式明确了企业与个人在德国职业教育法中的关系。德国职业教育法下的教育企业具有教育实施权、冠名权、获得回报权、教育评价权等法律权利,以及实施教育、安排教师、承担教育经费等义务。
