受教育权利的基本理论问题探讨

受教育权利,虽然已被世界人权宣言和我国宪法、教育法律宣示为“人之为人的基本权利”——人权,但在理论上,其基本含义是什么?具有什么性质?包括哪些内容?如何使受教育权利从一种法定权利转化为每个公民实际享有的现实权利?如何使公民被侵害的受教育权利及时获得补偿和救济等,学界对这些问题尚缺乏系统的理论上的研究,而这些问题不清楚,必将给实践中公民受教育权利的实现带来影 Although the right to education has been declared by the Universal Declaration of Human Rights and the Constitution and Education Law of China as “the fundamental rights of the human being”, it is, in theory, what is its basic meaning, what is its nature, and what is included How to convert the right to education from one legal right into the actual right that each citizen actually enjoys? How to make the right to education infringed upon by citizens promptly get compensation and relief? There is no systematic theoretical study on these issues However, these problems are not clear and will definitely bring about the realization of citizens’ right to education in practice
