农村宅基地使用权流转在新农村建设的进程中所发挥着不可或缺的功用。作为我国所特有的一种特殊存在的物权形式,同时也是农民最为重要的财产,宅基地使用权问题毫无疑问是农村经济发展的关键所在。然而立法中并无禁止城镇居民继承农村宅基地使用权,实践中也存在不同操作模式。城镇居民继承农村宅基地的可行性分析成为解决症结的必要条件。通过进路选择和必要限制的探讨,将会给相关权益主体带来更好的保护。
The transfer of rural residential land use right plays an indispensable function in the process of new rural construction. As a peculiar form of real property in our country, it is also the peasant’s most important property. The right to use house sites is undoubtedly the key to rural economic development. However, the legislation does not forbid the urban residents to inherit the right to use house sites in rural areas. There are also different modes of operation in practice. The feasibility of urban residents inheriting rural house sites has become a necessary condition for resolving the crux of the problem. Through the choice of access and the necessary restrictions, it will bring better protection to the relevant rights and interests.
