关于合同无效问题,很多学者也都提出了自己的见解和主张。但是,合同无效究竟“无”什么?本文主要对这一问题进行研究。笔者认为,合同无效的实质是合同对当事人没有法律约束力。它仅仅表明法律不强制当事人必须履行合同,并未表明合同不得履行,更未表明任何法律性的后果。 On the issue of invalid contracts, many scholars have put forward their own opinions and ideas. However, what exactly does the contract invalid? This article mainly studies this issue. The author believes that the essence of the contract is that the contract is not legally binding on the parties. It only shows that the law does not force the parties must fulfill the contract, did not show that the contract shall not be performed, but did not show any legal consequences.
