一般而言,仲裁可分为两种基本类型:临时仲裁和机构仲裁。因为中国现行法律只考虑机构仲裁,所以很多中方当事人可能对临时仲裁并不那么熟悉。中国在过去的几十年中继续向跨国公司开放其市场,因此,外商投资和交易的数量和重要性也随之增加,纠纷的数量也相应地增加。临时仲裁是一个很灵活的解决纠纷的方式。1994年的仲裁法笼统地派出了中国实行临时仲裁的可能性。然而,在一些例外的情形下,国际临时仲裁协议或裁决在一定程度上在中国具有效力。
In general, arbitration can be divided into two basic types: ad hoc arbitration and institutional arbitration. Because China’s current law only considers institutional arbitration, many Chinese parties may not be familiar with ad hoc arbitration. China has continued to open its markets to multinational corporations in the past few decades. As a result, the number and importance of foreign investment and transactions have also increased, and the number of disputes has also correspondingly increased. Temporary arbitration is a very flexible way of resolving disputes. Arbitration Law of 1994 has generally sent out the possibility of China’s interim arbitration. However, in some exceptional cases, the international interim arbitration agreement or award is to some extent effective in China.
