近年来,随着互联网的超速发展与互联网+概念的提出,网络技术深刻影响到商务贸易与民事交往等社会生活的诸多方面。为适应这一信息社会的产物,法律也必须不断丰富自己的理论内容与制度设计。而以地域主权为基础的传统管辖规则在对这一新生社会关系的磨合过程中,不可避免的产生了一系列不相适应的矛盾。网络法律关系的规制收到了前所未有的挑战。网络的跨区域性性,交互实时性,虚拟性等特点促使我们必须重新厘定管辖的价值所在,梳理地域管辖的理论与制度依据。
In recent years, with the rapid development of Internet and the concept of Internet +, network technology has profoundly influenced many aspects of social life such as business trade and civil exchanges. To adapt to the product of this information society, the law must also constantly enrich its own theoretical content and system design. The traditional rules of jurisdiction based on territorial sovereignty inevitably produce a series of incompatible contradictions in the running-in process of the newborn social relations. Regulation of the network legal relations has received unprecedented challenges. The cross-regional nature of the network, interactive real-time, virtual and other characteristics prompted us to re-determine the value of jurisdiction, combing the theory of geographical jurisdiction and institutional basis.
