自由与秩序是法律的基本价值目标,既对立又统一。近年来,校园网络贷款行业在大学校园迅速兴起,但由于相关法律法规的缺失,造成了市场秩序混乱。本文以校园网贷问题为角度,围绕法律的自由与秩序价值的冲突与协调展开论述,并重点分析了自由与秩序价值在校园网络贷款问题中的体现,并最后提出了建立两者的平衡与协调机制。
Freedom and order are the basic values of the law. They are both opposites and unities. In recent years, the campus network loan industry has rapidly emerged in university campuses, but due to the lack of related laws and regulations, the market order has been chaotic. This dissertation discusses the conflict and coordination of the freedom and order value of law from the perspective of campus net loan problem, and emphatically analyzes the manifestation of the value of freedom and order in the problem of campus network loan. At last, it puts forward the countermeasures to establish the balance between the two Coordination mechanism.
