2012年修订的《刑事诉讼法》及相关司法解释专门针对强制医疗的申请、审查、决定、解除和监督等问题做出专门规定,进一步完善了强制医疗程序。在司法实践中,强制医疗案件与普遍刑事案件在启动程序、审理程序、构成要件的认定、权利救济以及检察监督方式等方面均存在区别,厘清这些差异对于指导司法实践具有重要意义。 The 2012 Criminal Procedure Law and relevant judicial interpretations specifically enacted specific regulations on the application, examination, decision-making, dissolution and supervision of compulsory medical treatment and further perfected the compulsory medical procedure. In judicial practice, the differences between mandatory medical cases and criminal cases in starting procedures, trial procedures, the identification of constitutional requirements, right relief and procuratorial supervision methods are all different. It is of great significance to clarify these differences in guiding judicial practice.
