随着《物权法》的正式实施,我国不动产物权制度发生了较大变迁,这一改变对房地产市场中的产权取得、转让、抵押等各个方面都产生了深刻的影响。因而房地产抵押作为一项重要的物权变动制度,其今后面临的法律风险也将呈现出新颖性、复杂性和多样性。本文将就房地产抵押登记中的法律风险进行初步分析并提出相应的对策和建议。
With the formal implementation of the Property Law, there has been a great change in the system of real property rights in our country. This change has had a profound impact on all aspects of the acquisition, transfer and mortgage of property rights in the real estate market. Therefore, real estate mortgage, as an important system of change of real rights, will also bring newness, complexity and diversity to the legal risks it faces in the future. This article will conduct a preliminary analysis of the legal risks in real estate mortgage registration and put forward corresponding countermeasures and suggestions.
