对于我国房地产市场调控政策的有效运行,地方政府发挥着不可替代的作用;同样,房地产市场调控政策频频落空,甚至出现“逆调控”的现象,地方政府也有不可推卸的责任。规范地方政府的权力运行,加强对地方政府房地产调控权的法律规制,势在必行。本文从界定地方政府房地产市场调控权出发,通过区分调控决策责任和调控执行责任,进而对其责任构成、免责事由和责任承担方式等方面进行分析,以期促进地方政府房地产市场调控权的法律规范。
For the effective operation of China’s real estate market regulation and control policies, local governments play an irreplaceable role. Similarly, the regulation and control policies of the real estate market are frequently out of control, and even “reverse regulation” occurs. Local governments also have unshirkable responsibilities. It is imperative to standardize the operation of the power of local governments and to strengthen the legal regulation over the power of local government to regulate real estate. Based on the regulation of the real estate market of local government, this article analyzes the responsibility of the regulation and control and the implementation of the regulation and control, and then analyzes the constitution of its liability, the exemption reason and the way of bearing responsibility so as to promote the legal regulation of the regulation power of the local government in the real estate market.
