表面看来,权力和人权似乎毫不相干,甚至相互反对。强大的权力犹如一把悬在人们头上的德摩克利斯之剑,给人以莫名的恐惧和无尽的威慑感。和权力的强大威慑力不同,人权似乎只是一个软弱无力的空洞口号,甚至不过是政治家们利用权力玩弄于股掌之中的托辞。与此相应,在对权力和人权的研究中,尽管进展深入而广泛,遗憾的却是:对权力正当性的思考基本上停留在人性或德性的模糊层面,鲜有从人权
On the surface, power and human rights seem irrelevant and even oppose each other. The mighty power is like a sword of Damocles hanging over people’s heads, giving people a sense of fear and an endless sense of deterrence. Unlike the powerful deterrent of power, human rights seem to be a weak slogan, or even an excuse for politicians to use power to play in the palm of your hand. Accordingly, in the study of power and human rights, in spite of the deepening and extensive progress, it is regrettable that the consideration of the justification of power basically rests on the fuzziness of human nature or virtue,
