我国台湾地区由于市场经济较发达,劳动争议处理形成了一套较成熟且行之有效的制度。由于制度的原因,我国大陆现行的劳动争议处理制度不完善,不适应劳动争议案件快速增长的需要。本文拟通过对两岸劳动争议处理制度的比较,指出大陆劳动争议处理制度的不足,并借鉴台湾劳动争议处理制度中成功的经验,提出完善我国劳动争议处理制度的思路。 Due to the more developed market economy in Taiwan of our country, a more mature and effective system has been formed for handling labor disputes. Due to the institutional reasons, the current labor dispute handling system in mainland China is not perfect, which is not suitable for the rapid growth of labor dispute cases. This paper aims to point out the inadequacies of the labor dispute handling system in mainland China by comparing the handling systems of labor dispute across the Taiwan Strait and draw lessons from the successful experience in handling the labor dispute in Taiwan and put forward the idea of ​​perfecting the labor dispute handling system in our country.
