《物权法》在106条规定了不动产善意取得制度,使得传统上只适用于动产的善意取得制度突破了原有的界限,丰富了我国物权法内容,但对于不动产善意取得制度的适用范围及理论基础仍存在一定的误区。本文试从这两方面探讨不动产善意取得制度适用的必要性及合理性。
