一、船舶挂靠经营方式的弊端我国将国内水路运输业列为限制性经营行业,国务院《国内水路运输管理条例》第十七条规定,水路运输经营者应取得国内水路运输经营许可证,并保持相应的经营资质条件。但大量个体业者无法达到法定的经营资质条件,于是普遍采取将船舶挂靠在有经营资质航运企业名下的方式规避法律,曲线进入国内水路运输市场。对于船舶挂靠的概念,历来有争议,直到2012年12月最高人民法院制定了《关于国内水路货物运输纠纷案件法律问题的指导意见》
