反约翰起义中的两股主要势力是罗马教会与英国贵族,他们与约翰国王之争各有不同。教会、贵族、国王三者实际上代表着英国法律与国家发展的路径选择问题。通过普通法史和国家史两个方面对三方主张进行分析,可以理解斗争背后的深层动力。王权的存在是英国法治存在独特性的必要因素。国王权力的存在在英国法的历史发展中的作用可以从上述两个方面三方主张中得到明显的启示。
The two main forces in the anti-John uprising were the Roman Church and English aristocrats, who each differed from King John. The church, aristocrats, and kings in fact represent the choice of path to the development of law and state in Britain. Analyzing the tripartite assertions through both common law history and national history can understand the underlying dynamics behind the struggle. The existence of monarchy is a necessary factor for the uniqueness of the British rule of law. The role of the power of kings in the historical development of the English law can be apparently enlightened by the tripartite claims of the above two aspects.
