语言的模糊性和不确定性是任何一种语言存在的普遍现象,也是20世纪初哲学向语言转向(linguistic turn)的直接动因。模糊不清的客观世界需要用语言来阐释,但语言阐释功能的局限性和人类认识客观世界的无限性又使语言在阐释客观世界面前显得无能为力。模糊语言学研究的目的就是找出语言的不确定性或模糊性。法律语言的模糊性主要表现在法律术语观念的不确定性。法律翻译过程中,译者面临的问题首先是如何认定某一法律术语和概念在异域语言的对等层面和忠实程度,实现双语转换确切的意义对等。
The ambiguity and uncertainty of the language are common phenomena in any language and are also the direct motivation of the linguistic turn of philosophy in the early 20th century. The obscure objective world needs to be explained in terms of language. However, the limitations of language interpretation and the infiniteness of human understanding of the objective world make the language incapable of explaining the objective world. The purpose of the study of fuzzy linguistics is to find the language of uncertainty or ambiguity. The ambiguity of the legal language is mainly manifested in the uncertainty of the legal terminology. In the process of legal translating, the translator faces the problem of how to identify the equivalence and loyalty of a legal term and concept in the foreign language at first, and realize the exact meaning of bilingual transference.
