随着现代网上交易业务的迅速发展,“网络钓鱼”也成了网络安全的最大的威胁,对人们的正常网络交易造成了很多的麻烦。然而对于“网络钓鱼”行为的定性却存在着各种观点的争议,本文通过对各种观点的介绍和评析,认为其应该以非法获取公民个人信息罪定罪。 With the rapid development of modern online trading business, “phishing” has become the biggest threat to network security and has caused a lot of troubles for people’s normal internet transactions. However, there exists controversy over various aspects of the nature of “phishing” behavior. Through the introduction and analysis of various opinions, this article argues that it should be convicted of illegally obtaining citizen’s personal information.
