一直以来,学者对于清代的死刑适用问题的研究成果都偏少,但清代的死刑适用对于研究我国现阶段的死刑问题有很大的借鉴作用。本文以《大清律例》中“不道”罪为研究对象,对其适用死刑的要件进行归纳分析。此外,笔者在《刑案汇览》中找到相关判例进行研究,分析实然层面法律如何适用及法官如何把握法条精神的大方向做出自己的判断。 All along, scholars have made few studies on the application of the death penalty in the Qing Dynasty, but the application of death penalty in the Qing Dynasty has great reference for studying the death penalty at the present stage in our country. This article takes the crime of “no way” in “The Qing Rules” as the research object, and summarizes the essentials of the death penalty. In addition, the author finds relevant cases in “Penitentiary Reexamination” to study and analyze how the law at the actual level is applicable and how the judge can grasp the general direction of the law to make his own judgment.
