The Libyan conflict has caused widespread concern about the issue of investment protection in armed conflicts. This article addresses one aspect of the issue, namely, whether the BITs still apply in the event of an armed conflict. This article begins with a discussion of common clauses in BITs related to armed conflict and analyzes the applicability of BITs that include these clauses in armed conflicts. This article then discusses how to determine the suitability of BITs that do not contain such clauses based on the general rules of the law of treaties. Finally, the article analyzes the issue of the effectiveness of BITs and the responsibility for breach of contract when the rebel forces successfully seize power.
