上世纪90年代,继传统住宅之后,出现了一种新型的商业投资房产——产权式商业房产,产权式商业房产是一种所有权与经营权相分离的房地产投资产品。其特点在于房地产开发企业将其所有的大型商业物业分割成独立产权的面积较小的单位出售给投资者,投资者取得一定的占有,使用,收益和处分的权利。目前我国产权式商铺投资风险大,纠纷多,其主要原因就在于投资者未能正确预期投资的风险,而且法律对产权式商铺的归属等法律性质也没有明确的规定,学界各说纷纭,当因此而产生法律纠纷时,也没有相关的法律制度加以规范。本文致力于探讨产权式商铺权利类型。
