保罗·拉法格是杰出的马克思主义思想家和宣传家,他的法律思想至今仍然具有很大的理论指导意义。在他关于“正义思想的起源”的论述中,对从流血复仇到同等报复、再到伤害赔偿制度的发展进程做了详细的论述。同等报复克服了流血复仇的循环报复的缺陷,伤害赔偿制度克服了同等报复中对人的生命、身体的伤害。不仅如此,伤害赔偿制度也经历了赔偿数额不确定到逐步确定的过程。这个发展过程体现了抽象思维能力的进步和人类理性的增长。
Paul Lafargue is an outstanding Marxist thinker and advocate, and his legal thought still has great theoretical guidance.
